yw Let me know what you find out....Also.....The way it is at my local courthouse, is you can go in any time and if you have the case #, you can look up the case and search through all the docs yourself on their computers (they have like 4 sitting out for people to use) for FREE......and you can just print out the papers you want your self, walk over to the cashier (where the printer is) and pay them right there. Even if you can't get copies right away (if they are THAT busy), maybe you could just look at the docs if they have a similar system.........if you are still antsy to see how you were served. |

I had couple of question regarding judgments. I had judgment against me in MA where I lived for sometime. But the judgment was issued after I had moved and I was never served. This was a default judgment. Today I finally got the judgment vacated. The question that I have is, should I contact the CRA and ask to remove it from my credit report or does it go away on its own. I am trying to get a mortgage for buying a home asap and with this gone I am close to being debt free. The other question is the initial debt related to the judgment which I have been disputed with the CA and I havent heard from them. What should my next move be to get this debt of my record.

Hi....I have warrant of debt recorded against me by CA attorney in Virginia. The default judgment was awarded in April 09. I found out about this when reviewing my credit report when I received an alert on my credit monitoring service 7/2/10. I never received the summons in Apr 09. I have since found out from the court records that it was served by the sheriffs dept to my old address which I had moved out of 3 years before. It has been 1 yr and 3 months since the judgment. Should I try to vacate the judgment since I was not properly served ? (do not know what constitutes correct service) I believe I have 2 years after the judgment to do so. Should I also send a debt validation request to the CA attorneys. What should be my course of action overall? The original amount was $210.00 for my dentist (who did not have my correct address on record). I am sure that amount is now ridiculous. I am more than willing to pay off my bill but I was never given the opportunity to do so in the first place. Appreciate any help!! Thanks Satish |

Satish, You can do both. You can also send a dispute letter to the CRAs reporting it on your credit report.

Thanks Chane. I have done that as well and is now off my CR( within 5 days). I will now try to vacate my judgment and send out a debt validation letter.
