Angry Kramer & Frank Statute of Limitations

Hi,

Kramer & Frank got a judgement against me for Capital One for around $1,500.00. I tried to make payment arrangements for $50.00 a month and the Kramer & Frank lady said the minimum they would take was $100.00 a month and that they would be, "pursuing additional legal action". Whatever. So I told her what she meant by that. And she said she, "couldn't give out any legal advice." Such a lovely woman. I tried to pay...

My account went bad sometime in 2006. The judgement was issues against me in Kansas in November 2008. I have since moved to Texas where the statute of limitations is 4 years.

Questions:

1. Is the judgement enforcable in Texas?
2. Due to the statute of limitations how long does Kramer & Frank have to try and take this money from me?

I really want to make payment arrangements but I can't do $100.00 a month right now

Have to check Texas law.On a Judgement there is not really a sol.However a judgement is 10 years and can be renewed.Of course it depends on the state.If you want to pay i would send them the $50 but don't call them.If it went back to court you can tell them i tried to make payment arrangements but they didn't want to talk.Judges frown on creditors who refuse on payments,in texas the consumer laws are friendly.

Let me guess, you didn't show up for court and they got a default judgment against you? Not showing up is a big mistake.

Once they got that judgment, you're pretty much screwed. You can forget about SOL. If they took the time to get the judgment, they will take the time to renew it.

Pay them as much as you can and pay them off as fast as you can. Then dispute the judgment with the CRAs. That is my advice.
