I recently pulled my CR and noticed a Judgement dated 1/8/2007 from ASSET ACCEPTANCE LTD LIABILITY C. for a Ballys total fitness account when I lived in Rhode Island back in 2002. I never recieved a summons therefore a Default judgement was entered. My priority is removing this from my CR. Can I do a "pay for delete" on a judgement? Can I open this case? if so, how? Thanks in Advance.

No, you cannot do a PFD on a judgment. You need to look through the rules of service for your state and see what is considered "proper service". If you weren't served correctly, then you could file a motion to vacate judgment on those grounds. |
