I have several Federal (IRS) tax liens. After speaking with the IRS I was told that they all had a statute of limitations of ten years. The IRS said that they will take no steps to remove liens that have expired, but then told me what to do:

I went to the county courthouses where these liens had been originally filed and obtained copies of the liens. About a third of the way down there is a bold rectangular box which states:

Quote:
IMPORTANT RELEASE INFORMATION: With respect to each assessment listed below, unless notice of lien is refiled by the date given in column (e), this notice shall, on the day following such date, operate as a certificate of release as defined in IRC 6325(a).
I obtained certified copies of each lien ($1.25 each) and am in the process of mailing these to the credit agencies, requesting that each entry be removed.

Additional question is there a way and how to get a paid/released tax lien off the credit reports which was resolved back in 2006.

I do not have any first hand experience with tax liens.......but from what I have read Wide is correct in that tax liens will stay on your report for 10 years (and I believe that is from the date it was paid off).

I'm also wondering if how he's talking about disputing them will actually remove them?........or will they now be reported as released? Not sure.

What I have seen is that a tax lien should be disputed like other public records.
You can use the Guide To Disputing/Removing Judgments thread as a guideline..

I had a Tax Lien on my CR with TU, EX, & EQ from 2004 and was paid off in 2006. TU & EX shows being paid but EQ shows still being owed. I did find the Tax Lien is filed thru the county clerk/register of deeds. I sent them a letter asking them their procedure on verifying information which is reported by you to the credit bureaus.

I received from the county clerk/register of deeds stating " Register of Deeds is recording agency only and does not report information to any party. If a particular credit reporting agency has entered a negative item on your credit report then the credit reporting agency accessed our public records to obtain the information."

Right now I have letters out to the three CRA's to if they verify and how.

They can do it through a system Called pacer or lexius/nexius.They used to hire someone to check the public records, some still do.

The pacer system is used on the federal court system, they also use e-oscar to verify with ca's and oc on your first dispute.when you ask for a redo they the oc or ca should also send you results,or not respond at all which would cause the cra to delete.more and more they are getting sloppy on updating your files.all a cra reports is whats sent to them they could careless if its true.

SO if the third party is reporting bad info, how do I fight that ? Because I have REAL PROBLEM with that. That third party companies can report what they want w/o any question. Or am I just missing something here ?

That's what I have a problem with too. That's what the guide to disputing judgments will hopefully stop and get the public record deleted.

The CRA is basically lying by saying that a tax lien or judgment is being reported by the courts........when it IS NOT. They are getting the information from somewhere else...........but it doesn't say on your CR - info rec'd from Lexis Nexis......or the pacer system. So I think it's BS. And when we send the CRA a PR letter........they usually come back with a BS answer.

Nitro, you shouldn't have any problem getting it deleted. After you get the "BS" answer from the CRA, then send them a copy of that letter that you got from the county clerk and then tell them they need to delete it immediately.
