Default Equifax took over 30 days to respond

I disputed two items on my equifax report by mailing a letter on 5/13. I subscribe to equifax so I can pull an unlimited number of reports from their site, and I had noticed that they had removed one, but never added a comment like "customer dispute" on either account.

I had not received anything from them by 6/21 so I sent a follow up letter stating that since they had not replied to my dispute within the 30 days allowed, they needed to remove the other account to be in compliance with the Fair Credit Reporting Act. I included a copy of the my first letter with this.

Two days later (6/23), I received notice from them that the one account was removed and the other was "updated." Notice was dated 6/17 but was not mailed until 6/21.

As of today, the account that was deleted is still deleted, but the second account reads "customer dispute - under investigation."

My question is should I be able to demand that account be deleted since they did not send me notice of the results of investigation until after the 30 day window - even allowing for 5 days mail time on my original dispute?

Yes, absolutely. Keep disputing, but be careful not to send more than 1 letter per 30 days or you will extend their investigation time. Equifax is usually pretty easy to deal with, so if you stay persistent, I'm sure they will remove it.
