I just started trying to rebuild my credit. I sent NCS a Debt Validation Letter on March 1, 2010 and yesterday (3/9) I get a letter in the mail from NCS telling me that I owe the debt & if I wish to dispute the charge I have 30 days to do so in writing. Ummm.....I know they got my DV letter b/c I got the green card in the mail. Why would they send me that after getting my DV letter? and do I need to reply to that letter or just let the 30 days run from my letter dated 3/1/10 to them? Please help |

Wouldn't NCO be violating FDCPA by reporting bad information to the CRA's even though they have yet to validate my debt within the 30 day time frame? They got my letter on the 4th of MArch & then today I get an email from credit monitoring letting me know there has been a negative post on my credit report & it's from NCO. I thought they couldn't report bad information if the charge is being disputed. |

You should send them a DV2 letter letting them know that you still haven't rec'd proper validation of the debt AND "kindly" let them know they are currently in violation of the FDCPA and they need to stop all collection activity until they can prove that the debt is yours. Keep ALL records and paperwork on these guys. You may need it later. |
