Default OC past SOL, judgment not showing up?

OK this is the last thread tonight i promise...

i defaulted on a loan through a small loan company. they served me and like a young fool i forgot all about the court date. i called the courthouse after and they said "no arrest, no worries, its an automatic win for them and a judgement on your record." the OC came and got the collateral i listed (an oldish car and some computer equipment)

i dont see any judgements on my CR but the OC is still reporting the $1171

any reason i wouldnt be able to SEE the judgement? any chance it just didnt end up on my report?

You're lucky the judgment didn't get put on your CRs.....that's a good thing.
If it were there, it would be in the public records section of your CR. So, it looks like it just didn't get reported.

Does the OC state that the debt was paid? Was the debt completely satisfied with the collateral they picked up? If so, I would think the balance should be $0 and it should be reporting as a paid debt.

And how long ago was this?

it shows opened 03/2005, last active 05/2005, reported 01/2010 (is that out of SOL or within SOL). the loan was for $1500, i made a couple of payments of $250.

they're showing high balance 1,171 with 1271 past due. marked "profit & loss"

Look up your SOL by state. Sounds like this was a written contract so you need to see what the sol on that is.

It sounds like they may be reporting this incorrectly. Do you have any paperwork on them rec'd AFTER they took your collateral? Just wondering if they considered it paid at that point. :confused:

If there is any balance at all, that is what they should be reporting...
Also, if it states "profit and loss" then that sounds like it was charged/written off.... maybe if there was a balance, they wrote that off...

If that's the case, it should be reporting a ZERO balance.

written contract in NC is 3 years.

so assuming they have it all screwed up and are reporting wrong, and since the judgement isnt showing up, should i dispute with them directly or with the CRA's

Dispute it with the CRAs first.
If it comes back verified, then you would need to contact the company directly to let them know they are furnishing inaccurate information.

equifax asked if id like to opt-in to paperless correspondence from them.

they say they can reach me faster that way...

are there any negatives to doing this?
i have my email coming straight to my phone which came in very handy when i was tracking my CMRRR mail but i dont know if the CRAs being able to contact me "instantly" will somehow mess with the whole 30 days dispute window
