Last month I submitted a dispute letter to all three CRA's. There were 4 tradelines disputed. 2 of the accounts were marked as "disputed" on my credit report. The other 2 were not, yet they allowed the account to be updated without marking it as disputed or notifying me that it was verified. Is this another item to dispute now? I seem to recall that they can not continue reporting a tradeline that is disputed and has not been verified. |

So you're saying that they never reported the acct in dispute? Has it been the full 30 days (or 45 if it was a free report)? Do you have proof that you disputed the info (copies of letters and CM receipt) and copies of your reports with the dates on them showing they were never marked as in dispute? |

It has not been the full 30 days yet. I have copies of all my CM receipts. The two accounts they did mark as disputed were included in a list of 4 accounts. So they received the disputes and only bothered to mark two of them as disputed. The other two entries were updated (not changed, just and update to the "reported on" date). So they updated the record without marking it as disputed. I have a copy of the credit reports from TrueCredit.com

I would suggest waiting the full 30 days. Are you able to pull your CRs daily? If so keep track of those CRs (print them out, save them to your hard drive) for proof, just in case. This might be one to ask your atty about (if you have one handy to ask): When you dispute with a CA or creditor, by law, they have to report it as "in dispute". I am honestly not really sure how this would play out since you didn't dispute the acct directly with the creditor (if I'm understanding correctly) but you disputed with the CRAs. The CRA isn't the one that is obligated to mark the acct in dispute. I know there was controversy and confusion before as to how that works. One could say that since you disputed with the CRA, then in turn the CRA notifies the CA that the acct is in dispute, THEN the CA should be marking the acct as "in dispute". I hope that made sense. |

thanks Trish, you are right. I did verify this with my attorney. If the creditor updates new information without marking it as disputed, they're in trouble..but the CRA is not responsible to actually mark the disputed accounts. The two that ARE marked as disputed were verified by the original creditor. Don't know how though. These are the "re-aged" accounts that are showing 30 days late w/ an outstanding past due balance, although one of them was sold to a CA I sued the CA, won and the debt was expunged in the settlement. So there is no balance owing. Just gonna keep disputing it until they report correctly or remove the accounts. Snappy...whatever, you're a spammer! You've been caught and now you're trying to avoid being banned! Let's see how long until your next "CRB" post begging for someone to review them for you. Likely you won't post in here much in the future since you've been outed...that is the more likely outcome. |

i've had the same issue w/ eq. they never marked as in dispute. i sent a dispute w/ 3 acc on it, they eventually deleted two but never mentioned the third.(bty, third ca never responded to my dv letter

After reading this i have a few questions... 1. If I send DV letters to CAs and OCs does that constitute a dispute, or does it only count as a dispute if you are actually disputing specific information regarding the account? 2. I did send a dispute letter to the one CA that sent the proper validation. How long should it take for me to see this account listed as disputed on my CR and is there legally a time limit on how long they have to answer my dispute? |

i understand that the cra has 30-45 days to investigate and respond to my dispute, i was really wondering how long a ca had to respond, legally, if i dispute with them directly. I have an account that was validated properly, but I disagreed with the amount they were collecting, and sent them a letter along with my proof that the amount was incorrect. Just wondering if there was a legal time limit on how long they had to respond to my dispute...

if i understand correctly, there is no timeline for this. but they are not allowed to report until they respond. they can never respond and just disappear into the woodwork, sell your acc to the next and it starts all over.
