That's right, I sued a CA for violations of the FDCPA. It wasn't hard, they claimed to be w/ the police dept, then another guy claimed to be an attorney, and they left messages on my phone. Anyway, it didn't go all the way to court, I had a great attorney and he was able to settle with them for a substantial amount along with expunging the Collection Acct from my credit report. So, LEGALLY I no longer owe this debt, it was sold to the CA, I sued, and it was dissolved. I have a settlement statement verifying this along with a court order to the CA to remove the entry and cease reporting to the CRA's. So here's my "now what?!" question: The Original Creditor (OC) is still reporting the account as a charge off, closed (paid), acct transferred or sold, with a balance of $0. I disputed with the CRA's and within days I received a letter from the OC stating they verified the debt and what they are reporting is accurate. That's all it said...in just one paragraph. So now what? The account is outside of SOL and I have been released from the obligation by the court. Any ideas? |

Yes, legally you no longer owe the debt.......which was sold the CA. The OC is a different story.. as long as they are reporting it accurately, they can report it for 7 years. The OC will unfortunately be more difficult to remove......so really the best thing to do is just make sure they are reporting everything correctly and keep disputing it. |

That's what I figured. I have credit monitoring through True Credit. The merged report doesn't show information such as date of first delinquency, charge off date, or other key dates that could be items to dispute with the OC. I've noticed on other OC's things like changes in payment status, like it will show 120 days past due for a long time, then all of a sudden 30 days past due, then 60, then 90...like they started over or something. I never sent a payment to this particular one. |

Hmm... that's not right for them to start over......if that's what they're doing.. If you're not sure, you should look at the report(s) that come directly from the CRA.. When I used TC, I was able to get a CR straight from EX......as often as I wanted. I think it worked with TU too. When looking at your tri-merged report, look for the dispute options and see if there is a link to go directly to the CRA from TCs site.... hopefully that still works... if it does you can see your "real" report. |

yeah, there's a dispute button. I can get an Experian report as often as I like. I'll look into that. Thanks for your help. If the late payment status goes from 120 days to 30 days, then 60 days is that something I can dispute as possible reaging, which is illegal? |

Possibly.... I would try disputing that if it were me.. I found out that two 30 day lates back to back.....is more detrimental (scorewise) than a 60 day late.... doesn't make sense but that's what I was told by my mortgage guy. So it makes me think that showing 30/60/90......after it's been reporting 120 for a long time would bring your score down even more. |
