ok, found the letters, my bad. after looking at the letters, it SEEMS you could just tell the credit bureaus to verify that the original creditor sent the notices out to you. in other words, you can send in the first letter, as stated in the procedure, to the original creditor, but that doesnt prove to the credit bureau that they didnt send out the notice. in other words, seems like the credit bureau must be put on the spot to provide verification that the original creditor provided those notices, by sending YOU PROOF of the notices by the original creditor by validation of it?

No, the CRAs could care less about the notices sent to you. That will not get it off of your reports.
If they had not given the proper notices after the resale of the vehicle, then you would have a valid fight against the OC and would have to deal with them directly......and even then getting them to admit that they did not follow proper procedure is difficult (trust me, I went through this). It is the OC that would have to delete the TL and discontinue reporting........NOT the CRAs.
The only time the CRAs will delete the TL themselves is when/if the OC or CA does not verify/respond to your dispute.

If you did receive the notices, then once you send the OC a letter asking for verification of said notices.......more than likely they would produce the documents.
You're best bet would be to dispute any inaccuracies and/or deal with the OC directly to try and see if you can come to an agreement and have them remove any derogatory comments on your CRs.

You may want to also check your state laws because in some states if you paid off a certain percentage of the automobile, then you would not have a deficiency balance. I think it was like 60% but I'm not sure....you would have to check your state's UCC.

so, it looks like the only way to get it off your report would be to go to small claims court. that makes the letter to the cra, a waste of time. i know i didnt get any notices, they just came and got the cars, put the balance on my report and that was it.

Oy.....I misunderstood your previous post......when you said "ok, I found the letters, my bad".... I thought you meant you found the notices the OC sent you. :huh: Sorry... um can I just blame that on too much wine and lack of sleep? :rolleyes:

Ok... if you are positive you never rec'd the notices, then I think you should send the letters from why chat's site (the ones posted in the other thread I linked you to). That just might be enough to get them to remove it from your CRs. So try that first and see what their response is.

Again......sorry for the misunderstanding.

I have a similar score as you and just got financed for a car with the outrageous apr of 24%. Anything positive you put on your credit report will help your score eventually, and this is the reson I decided to let them abuse me with this extreme interesst rate.

Hello to everyone I`m new here and have a ques I think maybe for trish,you we`re talking about repo`s {doing them correctly" my wife had a repos two years ago and they never sent us any paper work before doing it, just called that day and ask if we where going to pay it off and then showed up about an hour later to get it,,,,,,,is that the legal way .OK thanks

No.. they are required, by law, to send you notices. Look in your state's UCC.....Article 9. It will explain what notices they are supposed to give you. If you did not receive any notices and it is reporting on your CRs.... you should look at the link I posted earlier in this thread.
