When does the SOL start, date first reported? If I'm outside of SOL, DV letter isn't going to work, correct? The reason I ask is because this account was fraudently opened using my social security number, but without my permission or signature by an ex (I wasn't even there!). But when I disputed it, of course Experian comes back "validated" I'd really love to see the original contract and my "signature." Or should I just let this one go and fall off in 2011? That's another 2 years.. ![]() Also, if you dispute an item or ask for debt validation, does that start the SOL over or only if you make some sort of payment? The SOL for collecting on an acct depends on your state (SOL by state in the beginner's section). The SOL clock starts from the DOFD (date of first delinquency) and no the clock will not restart just by disputing or sending the CA a DV. Ok.......if this acct was opened without your authorization, you need to dispute it as a fraudulent acct. You may even have to file a police report. If by chance this is still in SOL, 2k is enough for a CA to try and sue you over. I would start by contacting Radio Shack's fraud department. Let them know you just found out about this and you know for a fact you did NOT open an acct with them. You don't even have to tell them who did it. But you need to let them know that you are not responsible for this acct. |
