I spoke with the bankruptcy division of Honda so that may make a difference.

I am really stuck with this one as I don't know who to deal with... Should I go to Honda and see if they'll stop reporting it or should I keep disputing with the CRA's?

Okay I see what you are saying. Have them not respond to the dispute at all and then it would get dropped of my report. Sorry took me a minute... Now how would I go about doing this?

Well crap, I just got off the phone with Honda and because my atty didn't file a "reaffirmation" for the Honda they legally can not report anything after the bankruptcy was filed. :confused: So the Honda acct IS an IIB acct? I just want to make sure I'm understanding. If it is being reported as IIB OR as a CO......it's a derogatory. She is incorrect.

You can talk to them and have them put a notion in your file with that remark.

It was not IIB at all, I kept the car for three years after the bk. She stated to me that because I filed for bk they have to put that in the notations by law. It was paid on time every month for five years. Now because I did file for bk they by law have to put the discharge date as the date of close on the acct and can not report anything afterwards.

So the three years after my bk don't count towards my credit and the CRA's are reporting derogatory and it's showing like I ditched the car and didn't pay off the rest of the loan.

Ok.......I know I'm not too familiar with BK laws but that does not sound right AT ALL. If you didn't include it in BK.......it shouldn't be notated on the acct. :huh:

I have NEVER heard of that. I think you should check this info with your BK atty.

ETA: I'm going to see if I can find out if this is correct - just want to make sure of one other thing.......you NEVER defaulted on the loan right? All you did was trade it in......so it should be a positive TL, correct?

I just went through my bk paperwork and found two things to support my case, first being that there was a schedule filed with the court stating that said property would be exempt from the bk and the second is a statement of intention stating that the property would not be included in the bk. So now I am going to get back on the phone and see if I can work this all out. Now to find the phone number I wrote down earlier.

I hope I can get this all worked out...

Never defaulted on the loan, that baby was paid in full and three years after the bk was discharged, one 30 day late on the life of the loan which was five to six years. I just called my bk atty and they are going to look into it for me as well. Hopefully there will be a resolution tomorrow.

The one thing that bothers me is the lady is quoting law to you,she's not an attorney,If it was exempt from the bk then to them it should be like a bk never happened.Exemptable i kept two of my credit cards out of my bk,so they haven't reported it as being in bk:confused:

I am right there with you, this is why I am so confused. Plus I had a mtg at the time and that doesn't have any bk notations. So confused. Hopefully the atty will be able to clear things up tomorrow... :confused:

If it was a bk 7 your attorney will have you homestead the house so it wouldn't be in the bk,I'm assuming that the bk was homesteaded.
