I don't think there is a sample letter for that....

You just need to be sure and let them know that they are reporting an amount due that YOU were never responsible for. So they need to delete IMMEDIATELY since it is inaccurate and damaging your report/scores. Depending on how aggressive you want to be you can even tell them you will be seeking legal counsel if you do not response within xx number of days (depending on how quickly you want them to respond - 14 would be fine).

And yes, send the letter that you have as proof that it wasn't your responsibility to pay that and that it was a mistake.
Then keep after them. I would call to make sure they receive the fax or letter(get the name of the person that tells you they rec'd it)..........and then keep checking back with them. Be polite but be firm (and hopefully annoying enough for them to want to do this quickly).

If you do send it via snail mail.......be sure to send it CMRR.

yes it is - at least it better be soon! I can't wait to see these 2 deletions!!

I'm on it - I'm going to send letters today to both and I think I may actually call them as well. (maybe) we'll see, I may just send letters. :cool:

Well, I did send them an aggressive letter (with their own letter as proof) and to delete or respond in 14 days. It's been over a month and there has been no response or change. And it is greatly effecting our credit because it shows as a "recent" degr. account. I'm wondering if I should contact the b/k attorney at the time and see if they'll contact them or send them something. OR can I just get them and do something else??? man, they deserve it, this is sooo wrong of them!

Aw man. I thought for sure this would be straightened out! :mad:
Can you maybe call them up and ask what the delay is? Let them know that you wanted to check one last time before contacting your atty/filing suit.

Maybe that will light a fire under their arses! Grrrrr.

I've tried the letter (as mentioned) still no response, it continues to remain on report and I threatened legal counsel. I called them and one person was nice at first and then said, well I have to transfer you to supervisor, but it looks as if you do owe this. Then, disconnected. I have cell service only and honestly I don't think I'll get anywhere with them, so I didn't call them back and waste more minutes and money!

Here's what is on report...

Collection Agency listed
then original utility company

This is what it says on report (or at least close to it - changed only slightly in case some scum bag from c/a looks at!!:rofl...

I think the utility company is actually listed with some cb's too. the experian one I do not see it and others I'm waiting on. but I know transunion I think deleted the CA - but left the utility company on - I can't win!

This is destroying our credit!!! honestly, it is a recent baddie that is soooo untrue!!!! I'm about to sue for us not being able to get a mortgage because of this. It is crazy!

Date opened... 3/04 - what does that mean? really??? We moved in 03 to another state. The bank owned the property - even the entire year of 03 I don't think we even had to pay, but we did!!

I need some more input on this one or a sample letter - I think I had found one. I'll post it next once I retrieve and see anyone's thoughts on this.

So....

I left a message with b/k attorney from years ago. no word back. I was thinking they could help.

But... drama continues - I talked to utility company and they will not remove unless the bank or whomever proves and pays for their responsibility! now if they refuse (which they will) it falls back on me. IS that fair?? Honestly, I don't think so and I feel there should be SOMETHING, ANYTHING we can do about this! It is awful and awful timing this damn thing popped up as recent (it was removed) they gave me some BS that when they removed it years ago it was on a different account and bill which is not true. We need this removed ASAP. The damage to our report has to be HUGE with this one and it is ruining every chance we have or had for financing our home.

I let her know that it seems silly for them to risk $1,000 in fines, etc. for this bill that is reporting that we are not responsible for but it sounds like I may need an attorney to handle it!

Now, WHAT can I do? I don't care about fining them, going through a huge process, etc. I just want this removed NOW.

PLEASE HELP!

It's time to play hardball.I would send them a letter that they must cease and desist reporting this until it can be proven that this was not ever resolved years ago.Also state your intentions to seek legal advice to file a federal law suit.Then state that you will accept a complete deletion in lieu of damages for wrongful reporting of this paid account.

I did that already. They don't care. There is still a balance. However, we weren't responsible for it, we weren't living there! They said it doesn't matter.

I need to somehow find out the laws, etc. or maybe just seek legal council I guess.

Trish,

I haven't been on here - but welcome back! I know many have missed you and I hope you are better now.

Anyway, I'm posting this reply back to "refresh" my ordeal here - yeah, it is STILL going on.

I seriously just want to get this removed - it is continuing to lower the score and for no good reason and losing any chance we have on obtaining a loan. in fact, we'll probably lose our home is where it seems to be leading too - no one will finance, so I think we're done.

At any rate, I still need to work on this credit stuff, either though it may be take a major drop soon if we end up foreclosing.
