Default Stumped on this one...any ideas?

I have a discover card that is outside of SOL for Colorado. It was transferred and they recvd a judgment against me. My wages were garnished and the debt was paid through the judgment. The judgment is not showing on any of my credit reports (was satisfied 8/08).

However, the Discover Card is still showing w/ a balance and a pay status as Collection/Chargeoff. I want this trade line removed, but I don't want to risk having the Judgment reported. I don't want to awake the sleeping giant, if you know what I mean.

So after reading a lot and receiving some advice on another account from Trish, I think I can just dispute this account with the CRA's first. Or, should I send a validation letter to Discover? Bottom line, is I want this off of my report as it's paid or was transferred to a third party that eventually sued me.

It should definitely be reported as paid..... if not, that's something to dispute.

Oh and for an OC like Discover, you never want to send them a validation letter........there's a different kind of letter to send OCs.....they don't validate, they verify. :rolleyes: I know......sounds dumb but there is a different process to take with OCs. They don't necessarily have to respond to our letters.....but it is in their best interest to. If they completely ignore us (especially if they are not reporting the TL correctly) we can file complaints and possibly a lawsuit.

With an OC, you need to dispute it first. Then if it comes back verified/no change you go straight to them with a debt verification letter.

And you shouldn't have to worry about waking a sleeping giant. If you paid off the judgment.......then you no longer owe anything. It's not the OC that reports a judgment either........it's the CA/lawfirm that sued you. So disputing this shouldn't cause the judgment to appear on your CR. If it hasn't been reported on there already.........I doubt it's ever going to show up.
