As my saga continues I have two responses to my requests for validation. Now, let me say that I know that these are both my debts, I'm just trying to get them off my CR. I went through some difficult times and now I want to make things right. I had originally sent PFD letters, but got no response, so then I sent validations letters, and verification requests to the CA and CRA respectively. (I know that's backwards but I'm on a timetable here). Anyway, CA 1 sent me a copy of a bounced check as validation. CA 2 Sent me a computer generated printout of the old phone bills. Is this enough to constitute proper validation? If so, what should my next step be? I'm prepared to pay these debts the big thing is getting them off my CR if possible. Greatly appreciate any insight and advice. Thanks |

CA 1 - yes, a canceled check with your signature would be considered validation. CA 2 - Is the print out/bills from the OC? Is there an itemized list of charges showing exactly how they have arrived at the amount you owe? If so, then yes, that would be validation as well. Next step would be a PFD, but do Restrictive Endorsements hold up in your state? When you had sent them PFDs before, did you send them money? or just a letter asking for an agreement in writing? |

Thanks Trish, I'm in NY so the restrictive endorsement doesn't hold up here. My last PFD was a letter asking for an agreement. Maybe a new round of PFD's offering more money to settle this? I'm not really sure how to proceed from here. |

Yes, I would go ahead and try another round of PFDs. I knew a girl that sent out a round of PFDs......and was surprised when it worked......but what she did was took a picture of a money order written out to the CA stating that once they agreed, she would mail it immediately via CM. You just need to make sure that where ever you buy the MO (or cashier's check) that you are able to get a refund if they do not accept your offer. Just something to think about. It might make it seem like you are a little more serious. You could also try calling to work out a deal. I don't normally suggest that but if you are trying to do this quickly, you could possible set it in motion faster if you fax the agreement and have them sign it and fax it back. If you do call them, just remember to keep your cool. Be polite. I know it's difficult if you get a hold of an a-hole......but if you get someone rude, ask to speak to their manager. Just let them know you really want to take care of this but there is no incentive for you to pay if you cannot get it removed (if they tell you paying it will look better on your CR - that's BS. Paid is no better than unpaid on a collection acct.) If they tell you it's illegal to delete.....that's also BS. Reporting to the CRAs is completely VOLUNTARY. So, there are a couple of ways that maybe you could get it taken care of..... HTH |

I spoke to one of the CA's today. THis would be the one that sent me the copy of the check. They refuse to delete the TL and say that it's illegal to do so unless there is false information. They told me to send payment, make check payable to either them or the OC or both. Is it feasible to try and negotiate with the OC instead of the CA, it sounds as though they have been assigned to collect this debt and have not purchased it? Any advice on how to deal with this TL is greatly appreciated |

Thanks Chane, The only reason I called is because I am in a time crunch and trying to expedite this process. I was hoping I could get a favorable outcome. No such luck. I will contact the OC tomorrow and try to negotiate with them. Hopefully I can get the OC to have the CA remove the TL. Keeping my fingers crossed |
