I have a question regaurding CB. I have a few late payments that show on my CR, now some state I should start by disputing never late with Credit Bureau but dont the Credit Bureau ivestigate this with the creditor? I need to work on removing 6 late mortgage payments and I dont know what to do. Is it wise to dispute then in the mean time write a goodwill letter? I just dont want this to backfire on me!!! |

Hi Sharbear. Welcome ![]() I would start with gw letters first (you may have to send more than one).......or you could even do a gw call if you want to. Some have had luck with that. Then if those don't work......dispute them with the CRAs. Just an FYI (and I don't think this happens much but it has happened)......I have heard of people disputing lates on an otherwise good standing TL and having the whole thing deleted. It was more than likely because the OC simply didn't respond. So.....just thought I would throw that out there to let you know. |

My husband and I have a late payment that is showing up on a paid off car note from two years ago. We didn't find out that we were showing late until we looked at buying a house a few years ago. The loan was through WAMU. The car only had about 3 payments left, when we found out. We called to find out what was going on, because it was showing us 30 days late every month for about two years on a three year note. After having WAMU research this, they informed us that we didn't pay our first or second car payment. We know this isn't true. Unfortunately, we paid for a few payments with money orders and didn't keep the stubs from that far back. We aren't sure, if they didn't receive the payment, or they just put the payment to the wrong account. What we don't understand is how they could have us a month behind for almost 3 years and not contact us once. Do you think we could dispute this and have it removed or would a GW letter be better?

I would try calling and literally begging.......explain the situation and that if you knew you were that behind, you would have given an extra payment.......or figured it out and settled it then. Give them a good reason and sometimes you will find the right person to help you. Try to stay calm and polite. If whoever you speak to can't help.......ask to speak with their supervisor......and keep moving up if you need to. If that doesn't work, try writing a big wig. Research the company and see if you can find the address of the president.......or ceo. You also need to look into the FCBA (fair credit billing act) to see if reporting lates like that is even legal. Not sure that's right. |

This is something I just noticed also on my EQ its for a CC with an outstanding balance of $103!!!)90+ days late 25 times (Feb 2009, Jan 2009, Dec 2008, Nov 2008, Oct 2008, Sep 2008, Aug 2008, Jul 2008, Jun 2008, May 2008, Apr 2008, Mar 2008, Feb 2008, Jan 2008, Dec 2007, Nov 2007, Oct 2007, Sep 2007, Aug 2007, Jul 2007) Also, shows 1 60 day late and no 30 day lates! It also shows current status as bad debt/collection. Then on TU it shows no late payments and charged off as bad debt. Going to look into the FCBA and see what I can find, if anyone comes across this please let me know. |

Robbin, I looked around a bit last night and saw that a couple of people had a very similar problem (with 30 day lates reporting consecutively for years). the people responding to them seem to think that it's legal for a company to do that. Still going to look into it more if I can. Nixer.....I thought that once a debt was charged off that the lates were removed....but I'm not absolutely sure. I will look around too. I looked at the COs on my CRs but they are so old that I don't see the pay history that far back before it was written off. I will let you know if I find anything out. You should definitely dispute it if it is not reporting correctly though. |
