I have a paid $5,200 judgment that was paid in two months of garnished wages. I also have 2 unpaid collections that are $9,900 and $3,000. I am currently suing a collector over FDCPA violations (they called and impersonated the Sherriff's office AND a law firm and even left messages stating such...amazing, I know). Anyway, the case should be settled in the next few week. So, now my question: All of these derogs are within SOL and are less than 3 years. The Judgment was just paid off in August 2008. Is it too soon to have these removed? How easy is it to have a paid judgment removed? The collections are still unpaid, but I want them removed. I've read in some places that it's possible to have an unpaid collection removed. However, I've also heard that if you try to verify and validate an unpaid collection within SOL, you're setting yourself up for a lawsuit to obtain default judgment. Any ideas??? |

Are you trying to get the 9900 and 3000 removed? are you suing the ca for the derogs that you are trying to get removed? how old are the derogs that you are trying to get removed?

I'm still unclear. If I send a validation letter to to the CA within sol won't they just verify and obtain a judgement?

| They can't get a judgement without going to court.So check your local court house for any filings.If you get a summons you have to answer it or they will get a default judgement against you.

It's a numbers game and they know that most the time when they sue, the defendant won't even show up. Don't ever let that happen to you if you get sued. Never let them win by default. It's like tapping out before you even get into ring. At least give them a fight. You might be suprised at the outcome. Or, you may just want to leave them alone. It's up to you really.
