Hello Everyone, First thread and first post. Let me start by saying this looks like a great sight with a lot of very knowledgeable members. I have spent about the last two hours reading over the Beginner's area and searching out my questions, but I have a few still remaining I hope you can help me with. 1. SITUATION: I have active collections on my credit report, and despite my best efforts I have been unable to get in contact with the creditor. An example are two medical collections that I cannot identify from a company called: Premium Asset Recorvery Corp, or "PARC" (as it is shown on the credit report). My research has found that they tend to buy extremely old medical debt, and are quite unscrupulous in their collection efforts, and have lost many a lawsuit because of it. QUESTION: Should I even bother sending these people a DV, or can I just go straight to the CRA's and dispute this transaction with them? 2. QUESTION: Do you use DV's with the CRA's or is there a separate type of letter that you should use? 3. QUESTION: If an item on my credit report is past the statute of limitations but still being reported how do I get it removed? 4. QUESTION: If I have a collection on my credit report, that is a known debt I inccured, and I dispute it, is there a chance of the debt getting erased if the creditor doesn't respond in time? Would this action be construed as fraud? Would it perhaps motivate the creditor to settle in a more favorable fashion? 5. QUESTION: If i dispute a charge with a creditor, it is removed, and the creditor cannot prove it is mine, yet the charge re-appears on my report, what would be the next step? Do I need to get an attorney? Thanks for the help, I appreciate it! Note to Admins: I may be doing something wrong, but when I attempted to search the forums, I kept being told that my search terms needed to be longer than "4" characters in length, which they were. |

Welcome to the forums! It seems as though you can get these removed from your credit reports with a dispute letter to the CRA's. I say that because you mention that they are very unscrupulous. I'm in the beginning stages of repairing my credit. I'm still disputing my old addresses on my CR's and I cannot wait to dispute the collection accounts on them. There are some sample letters on the main site which may inspire you to write a really good one. It is your legal right to dispute any information on your CR's. If they cannot complete the investigation within the alotted time, they must delete the disputed information. All you have to say is, " please verify this derogetory information or remove" or something to that effect. You may want to send the collection agency a debt validation letter if they're really harrassing you. Samples of debt validation letters are on the main site as well. Just click the link on the left that says, "credit repair letters". If it does become verified by the CRA's or validated by the agency, you can send the collection agency a pay for delete letter, which negotiates with them that you will pay as long as they delete the account from your credit reports. I have answered your questions as best I could right now and I hope this helps. Oh and if the collection agency is harrassing you calling at all hours of the day or breaks any other FDCPA laws with you, then I would definately recomend getting an attorny. ; D |

Thanks for the reply Scorch! You would think that these collection agencies would be easy to get a hold of, but in many instances that is far from the case. At least in my situation I think your advice is good and just to go straight to the CRA's with my disputes. That being said if anyone else can chime in on my other questions I would appreciate it! S. |
