Default Same Credit Report Two Differnet CA

I just viewed my credit reports to find out that there is the same debt on there by 2 different Collection Agencies. How can 2 different agencies be on the same report with the same debt?

Can anyone help?

Sometimes an acct will get transferred or sold to another CA..... and you end up with double reporting.
Dispute them both and at least one of them should fall off.
You can just say you have no knowledge or records of either one.

Thank you for your reply. The date it was first reported was in 2004. I just got a letter from one of the CA saying they will take half the amount and call it even. I thought about calling them and saying if you take it off my CR first then I will pay.

With both of them on there wouldn't that make my score drop more then just having one?

I personally think that if one CA sells the account they should automatically take it off since they don't own it anymore.

I agree but CAs will never do anything that benefits us. :rolleyes:
Yes, you may see an increase in score if you get one of them off.

How old is the debt? For them to go as low as half might mean it's out (or soon to be out) of SOL.
If that's the case, you may have some leverage. I would send off a DV first and make them prove it's yours. If they send you proper validation, then see about going the PFD route. They may be willing to remove it in order to get paid.

Well, it says date opened on 04/2007, but it wasn't. This is an old Nextel bill that I haven't had since atleast 2003. I know that the dates on CR have different meanings but if date opened means the date I opened the account then they are wrong.

I will validate that too right?

If it's a CA, then the "date opened" is the date they acquired the debt.
To find out the SOL, you need to know the date of first delinquency (DOFD).
If you can find this on your CRs, it would be the first month you were late before the acct was charged off. Sometimes it is close to the DOLA (date of last activity) but not always.

If you have trouble finding the date or don't have it in your records, you can call up a CRA and ask them for the DOFD or FCRA compliance date so that you can know when it is due to fall off.

And I believe one of our other members had posted some info about cell phones only having a 3 year collection SOL.. If you want, I will try to find that info.

Thanks for the info. Is that the threads about u.s.c. section 47 415 a?

If so, I found them. I see that this covers suing, but does it as cover CR?
Example: do they have to take it off your CR after 2 years?

No,.... that SOL only applies to collections. The reporting SOL is 7 years.

So, should I send a letter saying that they are in violation of Federal Law and give code: Then say that if they don't remove this from all 3 CR then I will report them to the BBB and FTC and possible Federal Court?

I switched from this company to another in 8/04.
