hi all, so getting calls from ca saying that there collecting for another ca, who was collecting for the oc... got it? ha. so the ca calling me hasn't reported to the cra, but i sent dv letters to both. as well as dispute to the cra. so both ca's sent validation, the same exact validation. sent the first ca a pfd letter, after this the second ca validated. the first ca is off my cr. so should i send a pfd letter to the second ca or just wait it out? as i said the second ca hasn't reported ti the cra's (YET) sorry for the long read thanks |

Hmmm.... I don't think I would pay either one of them until you can get proof that they OWN that debt and they are legally entitled to it. Only one of them can hold the debt... so you should find out which one it is before paying. If you are still not sure, you may need to contact the OC. What exactly was the validation? Just print out? or was it proof from the OC/signatures.....etc. |

the oc was listed on my cr but was removed w/ dispute. the validation was a year worth copied statements, no signatures. the fact that the first ca didn't respond to the pfd letter leads me to believe that there out of the picture, as i said they were also removed from my cr after dispute. what would be proof that they are allowed to collect? |

Is the first CA (the one that fell off of your report) the older one as far as the dates go? You are probably correct.......but just to be safe, you can ask them to provide proof that they own the debt. There should be some written agreement between the OC and CA stating that they purchased or were assigned the debt. They are not obligated to show you this......but it would be wise for them to do so if they want to get paid. To be totally sure, you should contact the OC and explain the situation.... they should be able to tell you. |

yes, the dv i received from the 1st ca is dated 12/1/09 the dv from the 2nd ca is dated 1/5/10 i had called the oc (shouldn't do i know, now)last summer and was informed that they no longer owned the debt. ca #2 dunning letter said their client has offered a reduced settlement offer...blah blah so as it stands now nothing is showing on my cr, the 1st ca hasn't responded to my pfd letter, and getting phone calls(3 per day) from ca #2 unfortunately i had my dates wrong, so i'm over 30 days from their dv response! but the never sent proof they own the debt, which i asked for in my dv letter, as well as for them to only contact my by usps. i would like to avoid this showing on my cr if possible? should i send them a letter saying no proof was provided, there still phoning me, and therefore i my have to file suit? or just wait it out to see if they report and start the process over? thanks, sorry for the long read!! |

Ohh..... so they are still calling you after you requested not to be contacted by phone? Bunch of jackrods.... this is why I hate CAs. Send them a DV2 then and let them know they are in violation. Keep a good paper trail (pictures of caller ID, ALL correspondence). If your debt is under 1k, you have a good chance of getting them to eat the debt since they are breaking the law. thanks Trish, great info... yes its well under 1k...will send dv2 tomorrow so they'll probably just give up and sell it to the next ca, right:mad: have one more question! sent dv letter to a different ca... no response, also sent dispute to ex and eq eq never acknowledged it in there findings and ex had it listed as being investigated and now it's not listed as this anymore. had 2 tl's under investigation, the other one is still listed as such... this leads me to believe that it'll come back verified? so how should i approach this one? can the cra verify without the ca? the ca can't talk to the cra without validating to me right? sorry i think that was 4 questions |
