Capital One is trying to collect on a debt my x-husband created in my name. The original debt was for $774.00. I have been to court on this twice. First time the I asked for proof and continuance. The second time they set a summary judgment because I was given two different court dates and they said I did not show up for one of them. When I showed up the one I was given, the judgment was dismissed and a new date set. In the mean time, I have tried to settle with the Capital One and then was told it had been sold. I then tried to settle with the attorney/collection agency and was told it had been sold again. After contacting the 2nd collection agency/attorney I was told that it would be $1800.00 or nothing. I was willing to settle for $300.00. Also the Court has allowed them to be there by phone which does not seem fair but I'm in south Florida the attorney capital of the world. 1. Can they transfer this to another attorney in the mid-stream of the court dates? 2. How do I make them appear in court in person instead of by phone? 3. If they agree to the settlement in court what else do I request of them? TIA Laura |
