Default Sent Validation Letters... NOW THEY ARE CALLING

I sent a validation letter out for my girlfriend. 2 weeks ago.
She has not got validation yet from the debt collection agency.

This morning, they called her, and somehow tricked her to paying $50 on this account! BUT THEY HAVE NOT VALIDATED THE DEBT

What do I do from here?

How did she pay? Can she do a stop payment somehow? Was that just a partial payment?
That is a BLATANT violation. Do you by any chance have proof from caller ID that they called?

I should probably get your email somehow, because you always seem to answer all of my questions.

She did pay $50, and I will have her cancel it right now.

What action should we take?

Paid by debit card, partial payment, and they called from unidentified number.

Yeah, if you can stop payment somehow, do it. I wouldn't pay them a cent until they can show it's a legit debt. I know it may cost to do a stop payment.....so it's up to you.....but that's what I would do.

Either way, send them a DV2 (there is a sample in the validation letters thread) and I would even bold the section that states that you are AGAIN requesting that they not contact you by phone and only by US mail.

Keep ANY and ALL documents. If you can take pictures of your caller ID, do it. If you can record conversations in your state......do it.

If they call again, calmly remind them that you have requested not to be contacted by phone. If they are rude or continue trying to "talk" to you, just hang up on them.

Oh wow......I just realized you are right around the corner from me.
You can record conversations in your state if both parties are aware that the convo is being recorded.

I just had to do this. I went out to Radio Shack and bought an attachement device that hooks my phone up to my digital voice recorder. I was able to record two conversations with a CA that was calling without validating the debt......those recordings along with caller id pics are going to come in very handy when/if I file a lawsuit. :cool:
