I received a letter from a CA stating that I owed on an account. If I did not pay it would be sent to collections. I sent a settlement letter and payment(certified check, stamped on back if cashed..account payed in full, etc.). It has been 2 weeks and they have not cashed the check. How long do they have before they have to return payment or agree to the settlement offer? Can they old payment in indefinitely?

1st of all did you know you owed this debt?or even if it is yours? you should of had the verify it second i would of sent them a regular check so you had means to track it! via certified mail to prove they got it! They should of cashed it buy now! Did u keep a copy of this letter? Always keep proof of all coorisponence with collectors. so in future no one else can attempt to collect on it and you have proof it's paid . This happens to many people that debts are paid by westen union of money orders or cashiers checks and they have no proof of payment and another agencey tries to collect years later.second make sure it's not already on your credit report! if it's in collections it's already on your credit report! you need that proof of payment to negotiate with them to put this paid and in good standing on your credit report! since it's in default. |

I'm still working to resolve this with the CA. I sent Certified Check by Certified Mail. The CA will not send me a settlement letter but have agreed verbally to accept a settlement amount if I send a letter that states that the payment was for "settlement in full" NOT "paid in full" as stated in my original settlement letter. I also stamped the back of my check stating ".... for payment in full..." They still have not cashed my Certified Check received 3 weeks ago. Do they have an unlimited time to hold my payment? They sure do not want to send it back. Is "settlement in full" sufficient? Not sure what their end game is! |
