I disputed with CRAs a couple of collections. They were verified by the CA, but when I researched the CA they are not licensed. What do I do now?

Are they attempting to collect......sending you letters or calling you?

They aren't doing either. They just verified through the CRAs when I disputed them through the CRAs. But then I checked their license and they don't have one for my state. So I was going to dispute them again but then I didn't know if I should dispute or send them a letter directly telling them to delete it off my report and since they don't have a license that they cannot sell or trade out the account. Can that be done?

Well.....some people feel that merely reporting them to the CRAs is considered collection activity. I'm not so sure about that though. I have been fighting a CA that isn't licensed but they swear they are abiding by the law since they aren't attempting to collect on the debt. So you could try challenging that.......by sending them a letter letting them know that you know they're not licensed in your state. OR (this is what I would do first).......you could send them a DV and wait for them to respond. There's a good chance they will respond with a letter attempting to collect. Kinda sounds like entrapment......lol....but they know what state's they are licensed in. IMO, it's their own damn fault if they cross the line. If they do that, then you can send them an ITS and tell them that you want the debt eliminated.......and that they will not transfer or sell it to any other CAs. |

OK that sounds good. Now another question...How do I know if they actually own the debt or if they are just trying to collect it. A couple of the TL's are medical bills and two are when I actually had mediciad but the hospital had never ran it through and those are from many years ago.

You would have to ask the OC/original healthcare provider to find out if it's been assigned or sold. If it is for medical, you should try the HIPAA program. |
