CA name CA addy Greetings: In a recent review of my credit report, I noticed that your company has placed an erroneous and derogatory entry, claiming that I owe you $XXX.00. I have no account with you, nor have I ever. The account number referenced above is all the information that I have concerning this alleged debt. Since you saw fit to place this item on my credit report, you obviously have all the information you need in order to investigate and correct your error. Under the Fair Debt Collections Practices Act (FDCPA), I have the right to request validation of the debt you say I owe you. I am requesting proof that I am indeed the party you are asking to pay this debt, and there is some contractual obligation which is binding on me to pay this debt. Please also be aware that a sworn affidavit from your compliance officer does not constitute a valid validation of this debt. Please also be advised that this letter is not only a formal dispute, but a request that you cease and desist any and all telephone collection. I require compliance with the terms and conditions of this letter within 30 days, or a complete withdrawal, in writing, of any claim. In the event of noncompliance, I reserve the right to file charges and/or complaints with appropriate County, State & Federal authorities ,the BBB and State Bar associations for violations of the FDCPA, FCRA, and Federal and State statutes on fraudulent extortion . good news: this morning i was able to track down this record on a trans union report i just got back after a round of disputes. i was able to match the LVNV account with an HSBC account that i have a letter of removal from HSBC!! :D sweet!! so i'm giong to send a copy of the letter to Trans union, LVNV and HSBC as well as a general letter to Equifax and experian just in case it still reports. something like this: CRA ADDRESS RE: Account # To whom it may concern: The attached letter is a notice from HSBC stating that they are no longer to report this account. However, it still is showing on some of my reports and I wanted to send you this information in case you are still reporting it. If you have already ceased the reporting of this information, thank you. If you are still reporting it, please remove it at once or I will have no choice but to file a complaint with the FCRA and appropriate authorities. Thank you ME the letter i have from them is dated September 12, 2008!!!! Why hasn't this been deleted yet? i've actually sent copies of this letter before! Hmmm.......no offense but I'm just not likin this letter. :p Did you dispute this after you got the letter from HSBC? Was it ever removed and then reinserted? I was thinking this just popped up on your CR (or was that just the LVNV acct) but I'm a little foggy this morning. |

It told me that there has been a new account placed on my Experian CR from HSBC and LVNV for the same account. I looked in my saved received info today and found a letter from HSBC from Sept 2008 in regards to this account, that states that as of the date, HSBC will no longer report it to the CRA’s. no it was never removed. it has been removed from maybe one CRA on my husbands record. |

I was thinking a reinsertion letter would be more appropriate.........but that is when you dispute a TL, it gets removed and then pops back up on your CR (in which case your letter above would have been WAY too nice....lol). You know what though......I would really be hammering HSBC on this. It's their fault for continuously reporting it even when they said they wouldn't. I think sending them a letter would be more appropriate.... So maybe you could go ahead and try disputing it with the CRAs first.......but if that doesn't work, you should go after HSBC. |

i think i'll start with HSBC. i still have about 4 or 5 accounts on my CR from them, but i dont know what they are and they somehow always "verify" them

How did you get a letter from HSBC saying that wouldn't report anymore? My LVNV situation (I started the thread) began with an HSBC account. Like you, if I had somethign from HSBC, that would help with LVNV. Thanks for reading this! |
