Default CA question

I just received a letter today from a CA on an acct that my husband had and was charged off. The OC is reporting on his credit report but not the CA. Where do we go from here? Should I send a DV letter or would this re-start the SOL? Should I just let it be? I know he owes the money, however, we can in no way pay it, it's from two years ago. The SOL in our State is three years.

Oh and the amt that they are claiming he owes is close to $500 more than the OC.

Any advice would be much appreciated! Thanks!!

Who is the OC? How much is the debt for and what kind of debt is it?
Sending a letter will not restart the SOL.......but depending on your answers to the questions, there might be a couple of things you could do.

The OC is Credit One Bank, I *think* it's a credit card. I don't remember him having anything else. OC is reporting $1100 and change and the CA is asking for $1600.13.

Oh and could this have been brought up because I updated our addresses, removed old ones, etc?

Hmm.....that does seem a bit much tacking on $500.

This is what I would do.....so just my 2 cents.......but I would try calling the OC to see if there is ANY way to work things out with them. If the debt has only been assigned (and not sold) then you might be able to make some sort of payment arrangement with the OC.

If they tell you no.....then you have a choice. You can either ignore the CA and try to "hide it out" until it's out of SOL.........OR you can send them a DV and face it head on. IF they can send you proper validation (without violating laws)........then you may have work with the CA. As much as I would hate to do that....it would be a better alternative than getting sued. And it's very possible that for that amount.....they will try.

I guess the CA could have found you from updating your CRs....but it's more likely that they found you through a skip trace service. You can always check and see if they pulled your CRs recently.......then you would know for sure.

Thanks Trish, I am really stuck with what to do with this as we really can't afford to add anything to our monthly bills. According to his report, it is showing that the OC sold the debt and charged off the account.

This has been charged off for over a year and we have not heard a thing about it, I have also never heard from this CA.

UGH, tough stuff, money sucks, lol.

Well, the other thing we could do is look at the letter. If you don't mind posting it when you get the time ......we can look over it for any violations.

Just be sure to leave out personal info, acct numbers....things like that. CAs do read these boards so you have to be careful.

Okay she took forever to go to bed last night and my shotty wireless connection has sucked today.

Here's the letter, I am pretty sure I took all of his info out.

They don't own it it looks like it was assigned to them i could be wrong but if they owned it it would say we purchased it.I got a very good wireless at tigerdirect.com for under $30.00
