False advertisement not corrected. Help
A major dept store advertised in their ad a DVD box set Special Edition for $159. which is the price of the regular edition. When I told tell them the item they had displayed was not what was in the ad they completely agreed as it was clearly written on the front of the pic in the ad. But there was nothing they could do b/c after calling & checking every other store, they realized they were never shipped the item. only the regular edition(This store is partners w/ a store that sells both versions, though.)I called the main office they gave me the run around for 3weeks before they pretty much told me I didnt know what I was talking about. They tried to say there was only 1 version. I knew they made a mistake but I wanted to see if they would get me the item for $159. Oh, by the way, the regular version retails at $189 & the special edition retails for $300. A pic of the special edition in the ad for $159 was a steal. It said in small print on the back of the ad "blah, blah, blah, not responsible for photographic errors." I didnt think I was entitled to anything, I just wanted to see what they would say. They never said it was an error. They kept telling me that the one in the store was the one in the picture. Every phone call ended in them "getting back to me". I had one agent pull up the ad online & I acted like I couldnt read what was written in the picture in the ad b/c my eyes were bad. (I called as someone else). & he would not read what was on the item. He made up about 4 excuses of why he couldnt read the print. Oh, did I say it clearly said "Special Edition" on the front. lol. Anyway, I researched laws on consumer rights & it looked as though I had no case. I read that the small print covers them & it would only be an issue if they kept falsely advertising the item or didnt put out a correction. Well, about 4wks later there it was again. The Special Edition picture in the ad but now it was $129. Sure enough only the regular editions in the store. I called the main office. They still wont admit the error. They just act like they cant find any special edition. Im sorry this is so long & I greatly appreciate you taking the time to read this. Does anyone have advice on who I should contact next? Will the BBB do anything? I live in MD
